DISCUSSION / BACKGROUND

El Dorado County Probation Department (El Dorado) has an established Juvenile Detention Facility at the South Lake Tahoe Juvenile Treatment Center (JTC) for the temporary or long-term commitment of youth detained in accordance with the provisions of the California Welfare and Institutions Code.

 

On March 4, 2024, the County of Siskiyou (Siskiyou) posted a need for out-of-county youth placement on the Probation Business Managers Association (PBMA) website. Siskiyou’s interest was to enter into a contract as soon as possible. El Dorado Probation reached out to Siskiyou’s Probation Administrative Services Manager on March 6, 2024, to get further details and begin the agreement process. The process was moved along as efficiently as possible. Probation scheduled a Board of Supervisors date of May 21, 2024, knowing that the agreement was scheduled to be approved and signed by Siskiyou County on May 7, 2024.

 

Siskiyou desires to place youth of its Juvenile Court in the JTC, to the extent that accommodations exist. Rates payable to El Dorado are $350 per day per bed, $400 per day per bed for Commitment Programming, and $475 per day per bed for youth placed in the Secure Youth Treatment Facility (SYTF) Program.

 

The JTC offers four separate commitment programs ranging in length from 30 to up to 240 days. Youth are recommended for each program based on the youth's identified individual needs coupled with the available interventions and programs provided in each commitment.

 

In addition to the four commitment programs, the Cedar Program serves individuals ordered to a SYTF who have been adjudicated to have commissioned an offense listed in WIC §707(b) and would have resulted in a commitment to the Division of Juvenile Justice prior to its closure as described in WIC §875.  The Cedar Program will have varied commitment lengths with maintaining available services until the person attains 23 years of age unless the person at the time of adjudication would, in criminal court, have faced an aggregate sentence of seven years or more. Individuals who would have faced an aggregate sentence of seven years or more may remain in the Cedar Program until the person attains 25 years of age.

 

In the interest of promoting goodwill and so as not to disrupt any treatment plan in place for Siskiyou youth, this Agreement 8598 is retroactive to April 1, 2024.

 

ALTERNATIVES

The Board could not approve the agreement. This agreement promotes goodwill and reciprocity of assistance between California’s probation departments.

FINANCIAL IMPACT
