Title: Human Services Department recommending the Board approve and authorize the Chair to sign an ongoing Memorandum of Understanding (MOU) 417-M1011 with the California Statewide Automated Welfare System Consortium IV (C-IV), a Joint Powers Authority, to participate in the creation of a single, thirty-nine-county C-IV production system operational MOU that delineates areas of understanding and agreement between C-IV and the C-IV member counties at a current-fiscal-year cost of approximately $2,000 and an ongoing annual cost estimated at $45,064, said MOU becomes effective upon execution by all Consortium counties of this same MOU, remains in effect for one year and automatically renews for successive one-year terms unless terminated pursuant to the terms and conditions contained therein. Fiscal Impact/Change to Net County Cost:  No change.  Maintenance and Operation (M&O) costs associated with this MOU will be shared among all member counties.  Calculation of each County's annual share of costs will be based on an annual Persons Count completed by C-IV to determine actual usage by each member county.  For Fiscal Years 2010-11 through 2014-15, using 0.9% as the County's anticipated Persons Count share, El Dorado County's M&O share of cost is estimated at $45,064 per year.  Funds were budgeted for FY 09-10 to cover the single month for which costs may be applied, are included in the FY 10-11 County Budget request and will be included in each future fiscal year.
 
Background:  In 1979, the California Legislature passed Assembly Bill 8 requiring the Department of Social Services to implement a centralized welfare system in all counties, which resulted in four Consortiums being developed to meet this mandate.  El Dorado County is one of thirty-five counties that have shared use of the Interim Statewide Automated Welfare System (ISAWS) for the determination of welfare eligibility, to issue benefits and to manage welfare-to-work services.  
 
In 2002, the California State Legislature adopted language in AB444 to add ยง10823.1 to the Welfare and Institutions Code, thereby establishing legislative intent for ISAWS counties' migration to another consortium system and resulting in the ISAWS Consortium voting to disband and migrate to the C-IV Consortium.  
 
On April 17, 2007, the El Dorado County Board of Supervisors authorized the Chairman to execute Agreement 905-M0810, comprised of a Joint Powers Agreement (JPA) and Memorandum of Understanding (MOU), between C-IV and the County.  This JPA and MOU authorized El Dorado County to become one of thirty-five counties to join the existing four C-IV counties and begin using a new automated eligibility determination and benefit calculation system for public assistance programs during June 2010.  On March 1, 2010, the use of ISAWS was discontinued in this County and use of C-IV was implemented.  Implementation of C-IV in all member counties and execution of this MOU by all consortia members is scheduled for completion during June 2010
 
Reason for Recommendation:  Since 2007, the thirty-five migrating ISAWS Consortium counties and four original C-IV counties have operated under a single Joint Execution of Powers Agreement (JPA) with C-IV that clarified each agency's duties and responsibilities as they applied to their combined business requirements during the actual migration period and an associated MOU between C-IV and each of the 35 migrating counties.  Effective June 2010, all thirty-five migrating counties will have successfully migrated to the C-IV automated system.
 
MOU 417-M1011 supersedes all prior MOUs and formally joins the four original C-IV counties and thirty-five migrating ISAWS counties under a single thirty-nine C-IV county MOU that defines, clarifies and documents areas of understanding and agreement between the Consortium and the County with regard to unfunded costs designated by the State as ineligible for reimbursement to the Consortium.  Unfunded Maintenance and Operation (M&O) costs associated with this MOU will be shared among all member counties.  Calculation of each county's annual share of costs will be based on an annual Persons Count completed by C-IV to determine actual usage by each member county.  For Fiscal Years 2010-11 through 2014-15, using 0.9% as the County's anticipated Persons Count share, El Dorado County's M&O share of cost is estimated at $45,064 per year.  The MOU will automatically renew for successive one-year terms unless terminated pursuant to terms and conditions contained therein.
 
Action to be taken following Board approval:
1)  Chair to sign three (3) originals of MOU #417-M1011
2)  Board Clerk's Office to return two (2) original MOUs to Human Services at Briw Road
3)  Department to distribute as appropriate
