DEPARTMENT RECOMMENDATION
Surveyor's Office recommending the Board adopt a Resolution of Vacation for Abandonment of Easement (AOE) 18-001 to abandon a portion of the public utility and drainage easement on Lots 39 and 40 of "Park Village Unit No. 7", recorded at Book G of Subdivisions at Page 56. Request was made by Matthew C. Claudius, owner of Assessor’s Parcel Number (APN) 120-391-14.
DISCUSSION / BACKGROUND
On February 19, 1987, “Park Village Unit No. 7”, was recorded in Book G of Subdivisions at Page 56 whereon an irrevocable offer of dedication was made for a public utility and drainage easement on Lots 39 and 40 of said map. On April 29, 1988, Lots 38, 39 and 40 of “Park Village Unit No. 7” were further subdivided in Book 38 of Parcel Maps at Page 130, as recorded in the County of El Dorado, Recorder's Office. Parcel 3 of said Parcel Map is now a combination of Lot 40 and a portion of Lot 39 of “Park Village Unit No. 7”, and further identified as Assessor’s Parcel Number 120-391-14.
A request has been submitted by Matthew C. Claudius, owner of APN 120-391-14 requesting that the County of El Dorado, Board of Supervisors, vacate a portion of the public utility and drainage easement that is located on the subject property. Said easement is more particularly described in Exhibit A, and depicted on Exhibit B of the attached Resolution.
ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 18-001. By utilizing this alternative, the owner of APN 120-391-14, would be prevented from pursuing development that would impact this easement.
OTHER DEPARTMENT / AGENCY INVOLVEMENT
AT&T, Comcast, El Dorado Irrigation District and Pacific Gas & Electric have not used said easement for the purpose for which it was dedicated and find no present or future need exists for subject easement and do not object to its vacation, and to that end, have all issued letters to that effect.
Transportation Department has not used said portion of the easement for the purpose for which it was dedicated and find no present or future need exists for this portion of the easement and does not object to its vacation, and to that end, has provided written approval to the County Surveyor’s Office.
CAO RECOMMENDATION
It is recommended that the Board approve this item.
FINANCIAL IMPACT
There is no fiscal impact or Net County Cost associated with this item.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) Clerk of the Board to obtain the Chair's signature on the Resolution.
2) Clerk of the Board to record the Resolution at the Recorder’s Office.
3) Clerk of the Board to return a copy of the recorded Resolution to the Surveyor's Office for further processing.
