Title

Department of Transportation recommending the Board approve and authorize the Chair to sign the following for as-needed civil design support services, extending the performance period by two (2) years through October 1, 2028, and updating contract provisions to match current California Department of Transportation federal funding requirements, with no changes to the agreement amount:

1) First Amendment to Agreement for Services 7775 with R.E.Y. Engineers, Inc.; and

2) First Amendment to Agreement for Services 7776 with Dewberry Engineers, Inc., which additionally amends Exhibit B, Rate Schedule.

FUNDING:  Various Capital Improvement Program, Environmental Improvement Program, and other projects as needed, funding will be provided by associated Federal, State, and Local funding sources.

DISCUSSION / BACKGROUND

In January 2023, at the request of the Department of Transportation (Transportation), the Procurement and Contracts Division of the Chief Administrative Office issued a Request for Proposal (RFP) 23-925-040 for on-call civil design support services. Two (2) proposals were received and evaluated, and both proposals were selected as qualified firms. On September 26, 2023, Legistar 23-1181, the Board awarded the RFP and approved Agreement for Services 7775 with R.E.Y. Engineers, Inc. and Agreement for Services 7776 with Dewberry Engineers, Inc., each in the not-to-exceed amount of $475,000 to provide on-call civil design support services for various Capital Improvement Program projects.

 

The First Amendment to the Agreement 7775 and 7776 will extend the performance periods by two (2) years through October 1, 2028, updating the designated Consultant Project Managers, updating contract language to comply with Caltrans federal funding requirements, and updating the rate schedule for Agreement 7776 to amend some employees/classifications with no increases to the rates. The 2027 rates have been agreed to extend into 2028 through the term of the contract.

 

The following articles have been updated for Agreement 7775:

Article IV, Performance period, paragraph A;

Article XXII, Consultant’s Project Manager;

Article VII, Cost Principles and Administrative Requirements;

Article X, Subcontracting;

Article XLIV, Disadvantaged Business Enterprises (DBE) Considerations; and

Article XLVI, Disadvantaged Business Enterprises (DBE).

 

The following articles have been updated for Agreement 7776:

Article II, Compensation for Services, Exhibit B, Amended Rate Schedule (classifications only);

Article IV, Performance period, paragraph A;

Article XXII, Consultant’s Project Manager;

Article VII, Cost Principles and Administrative Requirements;

Article X, Subcontracting;

Article XLIV, Disadvantaged Business Enterprises (DBE) Considerations; and

Article XLVI, Disadvantaged Business Enterprises (DBE).

 

ALTERNATIVES

The Board could direct Transportation not to approve one or both amendments or to make changes and return to the Board at a later date.

FINANCIAL IMPACT

There is no change to net County cost. Funding for the Agreement will be provided by various project budgets, including federal, state, and local funding sources. Local funding sources may include any combination of the following: Traffic Impact Fee Program, Missouri Flat Area Master Circulation and Financing Plan, Road Fund, Tribe Funds, Developer Advanced Funds, Sacramento Municipal Utility District, and/or General Fund.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on one (1) original of both amendments.

2) The Clerk of the Board will forward one (1) fully executed copy of both amendments to the Chief Administrative Office, Contracts and Procurement Unit, for further processing.
