The $147,016 to be secured through this Exchange Fund Transfer Agreement will be programmed in the Fiscal Year 2014/2015 (FY 14/15) Budget.  The Project with associated funds is included within the approved 2013 Capital Improvement Program (CIP).
 
Fiscal Impact/Change to Net County Cost
There is no change to net County cost.  Funds are programmed in the CIP for FY 14/15 and will be included in the FY 14/15 Proposed Budget.
 
Background
Section 182.6(g) of the Streets and Highways Code authorizes the Tahoe Regional Planning Agency (TRPA) to exchange the assigned Federal apportionments made available to TRPA under the "Safe, Accountable, Flexible, Efficient, Transportation Equity Act - A Legacy for users" (SAFETEA-LU), Regional Surface Transportation Program (RSTP), for nonfederal State Highway Account funds.  Through Agreement numbers: X12-6125(028) and X13-6125(029)] pursuant to Section 182.6 of the Streets and Highways Code, between Caltrans and TRPA, these funds have been exchanged for a like amount of State funds.  TRPA has accumulated these State funds over prior period funding cycles and the activities proposed by the Community Development Agency, Transportation Division (Transportation) meet their funding criteria.
 
In order for El Dorado County to receive these exchanged funds from TRPA, an Exchange Fund Transfer Agreement (EFTA) between TRPA and El Dorado County is needed to transfer the State funds.  The funds are proposed to be used within the Tahoe basin on the Sawmill 2B Bike Path and Erosion Control Project (CIP No. 95192), which is included within the TRPA Environmental Improvement Program.
 
Reason for Recommendation
This recommended action will allow Transportation to receive $147,016 of State revenue through the TRPA for the construction and related construction engineering work for CIP No.95192, Sawmill 2B Bike Path and Erosion Control Project, which is programmed within the 2013 CIP.
 
Action(s) to be taken following Board approval
1. The Clerk of the Board will obtain the Chair's signature on two originals of the Exchange Fund Transfer Agreement with the TRPA.
2. The Clerk of the Board will return two partially executed original Agreements to Transportation for further processing.
 
Action(s) to be taken by Transportation following Board approval:
1. Transportation will forward the two partially executed original Agreements to TRPA for signature and upon return of one fully executed Agreement from TRPA Transportation will forward said Agreement to the Clerk of the Board.
2. Transportation will prepare an invoice to obtain the available funding.
