DISCUSSION / BACKGROUND

On July 7, 2022, the District Attorney’s Office entered into a facility lease agreement (#6764) with G&O Towing Inc (G&O). This lease agreement provided the District Attorney’s Office access to an existing, secured facility on G&O’s property for the purpose of storing evidence vehicles and other items as needed. The cost of the lease agreement was $3,000 per month. Agreement 8462 renews the lease for the same purposes, at the same cost of $3,000 per month, for a 3-year term, resulting in a total amount not to exceed $108,000. 

 

In accordance with County Ordinance Code 3.12 and 3.13, the Board of Supervisors and the Purchasing Agent have the authority to enter into facility rental agreements for its offices. Furthermore, the Purchasing Agent may only enter into contracts provided the total contract amount does not exceed the amount allowed by Government Code section 25502.3. Agreement 8462 amount of $108,000 exceeds the Purchasing Agent’s authority threshold of $75,802. The department is requesting the Board approve and authorize the Purchasing Agent execute lease agreement 8462 with G&O Towing Inc., including any future amendments that do not alter the agreement amount or term.

 

ALTERNATIVES

Should the Board opt not to approve the Purchasing Agent to execute facility lease agreement 8462 with G&O Towing Inc, the District Attorney’s Office will no longer have access to a secured facility for the storage of evidence vehicles and other items as necessary.

FINANCIAL IMPACT

The execution of agreement 8462 with G&O Towing Inc. does not result in any increase to Net County Cost. Expenses for the lease renewal have been accounted for in the District Attorney’s Fiscal Year 2024-25 budget.
