Fiscal Impact/Change to Net County Cost:  Estimated costs and associated funding are incorporated in the Department's approved budget.  There is no Net County Cost associated with this Agreement.

 

Background:  The Substance Abuse Offender Treatment Program (OTP) was established in fiscal year (FY) 2006-07 per Health and Safety Code Division 10.10, Chapter 75, Statutes of 2006 (Assembly Bill 1808), and was funded by the State of California Department of Alcohol and Drug Programs to serve offenders who qualify for services under the Substance Abuse and Crime Prevention Act of 2000 (SACPA).  The State OTP Program was authorized for two years, and was to be repealed effective July 2009; therefore, effective FY 2009-10 the OTP State funding ended.

 

To ensure ongoing services through the County Alcohol and Drug Program (ADP) the County ADP Manager applied for and received American Recovery and Reinvestment Act funding through CalEMA and the California Department of Alcohol and Drug Program.  This grant funding is a one-time grant through the American Recovery and Reinvestment Act of 2009 and is designated to be used to provide substance abuse treatment for criminal offenders in the County OTP Program.  Progress House will perform required treatment services pursuant to this Agreement.

 

Compensation for Services:  Payments are made to Contractor based upon monthly invoicing at specified billing rates for actual services performed and documented per contract requirements.  Services and rates are detailed in Exhibit E, Service Reimbursement Schedule. 

 

Contract Termination:  This Agreement includes the County’s standard Fiscal Considerations termination language, as well as the County’s standard provision for County to terminate the Agreement without cause upon seven (7) calendar days written notice.

 

Retroactive Term:   The Notice of Grant Award for the CalEMA funding was received in February 2010; however, the term of the grant begins October 1, 2009 and expires March 31, 2011.  A Budget Transfer Request appropriating funds for grant-funded activities was submitted and approved by the Board on May 11, 2010.  Upon approval of the appropriation, this Agreement for Services was drafted and submitted for review and approval.  The Agreement was processed as expeditiously as possible and submitted to the Board for approval at the next available Board date.

 

Reason for Recommendation:  Approval of this Agreement will ensure ongoing substance abuse treatment services for the OTP clients in the County of El Dorado.  Progress House is currently the only local licensed ADP provider that offers both residential and transitional housing treatment services (24/7).

 

Action to be taken following Board approval:

1. Chair to sign three (3) original Agreements 097-135-P-E2009.

2. Board Clerk’s Office to return two (2) signed Agreements to Department.

3. Department to distribute documents as appropriate.
