DISCUSSION / BACKGROUND
On July 13, 2021 (Item 25), the Board approved the Introduction (First Reading) of Ordinance 5143 to repeal Ordinance 4476 Section 15 and Ordinance 4591 which established and amended the membership of the Environmental Board of Appeals and Continued the matter to July 20, 2021 for Final Passage (Second Reading).
On April 6, 2021 (Item 46), in accordance with Board Policy A-3, the Board gave conceptual approval to repeal Ordinance 4476 Section 15 and Ordinance 4591, which established and amended the membership of the Environmental Board of Appeals.
The Environmental Board of Appeals was established in 1998 by Ordinance 4476 Section 15 to provide reasonable application and interpretations of the Tahoe Regional Planning Agency (TRPA) El Dorado County Memorandum of Understanding (MOU) and the Tahoe Regional Plan as it pertains to the MOU. Ordinance 4591amended Ordinance 4476 to allow for the appointment of two alternate members to the Environmental Board of Appeals.The MOU has been updated and the Environmental Board of Appeals is no longer necessary. Staff have confirmed this with TRPA. As a result, the Clerk of the Board is requesting conceptual approval from the Board to move forward with repealing Ordinance 4476 Section 15 and Ordinance 4591.
ALTERNATIVES
The Board could decide not to approve to repeal Ordinance 4476 Section 15 and Ordinance 4591.
