Community Development Agency, Environmental Management Division, recommending the Board consider the following:
1) Make findings that an outside independent contractor can more economically and feasibly perform work in accordance with County Ordinance Chapter 3.13, Section 3.13.030; and
2) Authorize the Chair to execute Agreement 206-C1711 with Doug Veerkamp General Engineering, Inc.; and Agreement 207-C1711 with Joe Vicini, Inc., for the provision of as needed construction maintenance for the Community Development Agency, Environmental Management Division, Union Mine Disposal Site, in an amount not to exceed $300,000 for each Agreement, for a three-year term commencing November 12, 2016.

DEPARTMENT RECOMMENDATION
Community Development Agency, Environmental Management Division (EMD), is recommending approval of new three-year as needed construction maintenance agreements with Doug Veerkamp General Engineering, Inc. (Veerkamp) and Joe Vicini, Inc. (Vicini), for EMD's Union Mine Disposal Site.
DISCUSSION / BACKGROUND
EMD currently has agreements with Veerkamp and Vicini to provide construction maintenance for the Union Mine Disposal Site to be performed on an as-needed basis for a three-year term expiring on November 11, 2016. Services requested through the current Agreements alternate between Veerkamp and Vicini, depending on their current workload and labor force. Both contractors have particular knowledge of, and experience with, landfill facilities and operations. EMD has been satisfied with the work performed by both contractors.
An outside independent contractor can more economically and feasibly perform the maintenance in accordance with County Ordinance Chapter 3.13. EMD does not possess the trained personnel or equipment necessary to perform the construction maintenance work. Pursuant to California Public Contract Code, Section 20121.1, day-to-day landfill operations are exempt from the competitive bid process.

FINANCIAL IMPACT
Funding is available in the adopted Fiscal Year (FY) 2016/17 budget, and will be recommended for appropriation in the FY 2017/18 and FY 2018/19 budgets. Work performed under the proposed Agreements will be paid for with County Service Area 10 property tax assessments dedicated to solid waste activities. There is no change in Net County Cost.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Board Clerk will obtain the Chair's signature on two (2) originals of each Agreement; and
2) The Board Clerk will forward one (1) original of each Agreement to the Community Development Agency, Contract Services Unit, for distribution.
