Fiscal Impact/Change to Net County Cost:
There is no Fiscal Impact associated with this agenda item.  There is no Net County Cost.
 
Reason for Recommendation:
Public Contract Code Sections 20395, 22035, and 22050 authorize the County in such an emergency as the Angora Fire to immediately repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts upon a 4/5 vote of its governing body.
 
On September 11, 2007, the Board authorized the Transportation Department (Department) to dispense with competitive bidding requirements and authorized the Director of Transportation to sign contracts to allow for the immediate performance of emergency repairs and restoration due to the limited time to install the measures and the onset of winter.  
 
The Contract for the Angora Fire Emergency Rehabilitation Project - Zone D (Project) was executed by the Director of Transportation on October 10, 2007.  The Project was substantially completed on November 4, 2007.
 
The Work completed is described as follows:  Construction of fire rehabilitation improvements included tree removal, grading, stump removal, rock slope protection, sheet pile installation, and trash rack.  These improvements were constructed within three United States Forest Service parcels (APN's: 033-531-06, 033-531-07, and 033-542-08) under special use permits, and two private parcels (APN's: 033-542-06 and 033-542-07) within an existing County easement and along the following streets: Angora Creek Drive and Lake Tahoe Blvd.
 
The Board actions above will start legal time frames for guarantees, a lien period, and return of retention monies.  White Rock Construction, Inc. acceptance of the final Contract cost is attached and summarized below:

Construction Contract Item Cost:    $199,945.00
Contract Change Orders:                    ($4,804.67)
Final Cost of Construction:         $195,140.33
 
Action to be taken following Board approval:
1) The Chairman will sign the Notice of Completion.
2) The Board Clerk will send the Notice of Completion to the Recorder/Clerk's Office for recordation and forward a copy of the recorded Notice of Completion to the Department.
