1) Approve and authorize the Chair to sign a Communications Ground Lease Agreement 25-2076 between the County of El Dorado and the California Department of Technology for use of a portion of the Missouri Flat Park & Ride property for construction, operation, and maintenance of telecommunications infrastructure supporting the Statewide Open-Access Middle-Mile Broadband Network; and
2) Authorize the Director of Transportation, or designee, to execute all related project documents required to implement the Agreement, including the California Civil Rights Laws Attachment and Federal Debarment Certification Form.

DISCUSSION / BACKGROUND
California Department of Technology (CDT) has requested use of approximately 2,400 square feet located at the Missouri Flat Park & Ride facility (APN UN1336048), located in unincorporated El Dorado County, for installation of a telecommunications infrastructure associated with the Statewide Open Access Middle-Mile Broadband Network. Proposed site improvements include installation of a fiber communications hut, generator, propane tank, electrical service equipment, and associated utility infrastructure necessary to support broadband operations.
The proposed lease agreement authorizes CDT to access and utilize the site for construction, operation, maintenance, repair, and removal of broadband telecommunications equipment necessary to support the statewide broadband network. The agreement provides for an initial twenty (20) year term with two optional five (5) year extensions.
Annual rent is established at one dollar ($1.00) per year in recognition of the public benefit associated with expanded broadband infrastructure and improved telecommunications connectivity within the region. CDT will be responsible for all costs associated with installation, operation, maintenance, utilities, and removal of the telecommunications equipment and facilities.
As a condition of executing the Agreement, CDT requires completion of ancillary compliance documents, including the California Civil Rights Laws Attachment and a Federal Debarment Certification Form. These documents do not alter the substantive terms of the lease but are required to satisfy state and federal compliance requirements associated with the project. Staff recommends that the Board authorize the Director of Transportation, or designee, to execute these documents and any other non-substantive administrative forms necessary to implement the Agreement.
ALTERNATIVES
The Board may choose not to approve of the proposed Agreement. Transportation staff would return to the Board with modifications as directed.

CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain Chair signature on four (4) originals of each Agreement.
2) The Clerk of the Board will forward the signed four (4) originals of each Agreement to Matt Gourley at Transportation for transmittal to Caltrans for final signature.
3) Upon receipt of the fully executed original Agreements from Caltrans, Transportation will forward one (1) original of each Agreement to the Clerk of the Board for filing.
4) Transportation will obtain and execute all required ancillary compliance documents, including the California Civil Rights Laws Attachment and Federal Debarment Certification Form, consistent with the Board’s authorization.
