Title

Health and Human Services Agency (HHSA) recommending the Board:

1) Make findings that the provision of County-wide youth Specialty Mental Health Services (SMHS) provided by the providers listed below are in the public's best interest and that there are specialty skills, qualifications, and equipment not expressly identified in County classifications involved in the performance of the work in accordance with El Dorado County Ordinance Code, Chapter 3.13.030(B), El Dorado County Charter, Section 210(b)(6);

2) Authorize the Purchasing Agent to execute the finalized competitively procured Agreement for Services 9008 with New Morning Youth & Family Services (New Morning) for provision of SMHS, similar in form and scope to the sample SMHS agreement attached (Attachment A), contingent upon approval by County Counsel and Risk Management, in the amount of $795,000 for the initial 18-month term from January 1, 2025, through June 30, 2026, with the option for a one-year term extension through June 30, 2027, and an additional $500,000 if the extension is granted, contingent upon written approval by the HHSA Director, for a total maximum obligation of $1,295,000;

3) Authorize the Purchasing Agent to execute the finalized competitively procured Agreement for Services 9031 with Summitview Child & Family Services (Summitview) for provision of SMHS Short Term Residential Treatment Program (STRTP), similar in form and scope to the SMHS STRTP sample agreement attached (Attachment B), contingent upon approval by County Counsel and Risk Management, in the amount of $2,385,000 for the initial 18-month term from January 1, 2025, through June 30, 2026, with the option for a one-year term extension through June 30, 2027, and an additional $1,500,000 if the extension is granted, contingent upon written approval by HHSA Director, for a total maximum obligation of $3,885,000;

4) Authorize the Purchasing Agent to execute the finalized competitively procured Agreement for Services 9032 with Summitview for provision of SMHS, similar in form and scope to the sample SMHS agreement attached (Attachment A), contingent upon approval by County Counsel and Risk Management, in the amount of $2,146,500 for the initial 18-month term from January 1, 2025, through June 30, 2026, with the option for a one-year term extension through June 30, 2027, and an additional $1,350,000 if the extension is granted, contingent upon written approval by HHSA Director, for a total maximum obligation of $3,496,500;

5) Authorize the Purchasing Agent to execute the finalized competitively procured Agreement for Services 9033 with Stanford Sierra Youth & Families (Stanford) for provision of SMHS, similar in form and scope to the sample SMHS agreement attached (Attachment A), contingent upon approval by County Counsel and Risk Management, in the amount of $2,067,000 for the initial 18-month term from January 1, 2025, through June 30, 2026, with the option for a one-year term extension through June 30, 2027, and an additional $1,300,000 if the extension is granted, contingent upon written approval by HHSA Director, for a total maximum obligation of $3,367,000;

6) Authorize the Purchasing Agent to execute the finalized competitively procured Agreement for Services 9034 with Sierra Child & Family Services (Sierra) for provision of SMHS, similar in form and scope to the sample SMHS agreement attached (Attachment A), contingent upon approval by County Counsel and Risk Management, in the amount of $3,339,000 for the initial 18-month term from January 1, 2025, through June 30, 2026, with the option for a one-year term extension through June 30, 2027, and an additional $2,100,000 if the extension is granted, contingent upon written approval by HHSA Director, for a total maximum obligation of $5,439,000;

7) Authorize the Purchasing Agent to execute amendments relating to Agreements 9008, 9031, 9032, 9033, and 9034, contingent upon approval by County Counsel and Risk Management, which do not increase the maximum dollar amounts or terms of the Agreements;

8) Authorize the HHSA Director and HHSA Chief Fiscal Officer, or their designees, to reallocate maximum obligations among these SMHS Agreements 9008, 9031, 9032, 9033, and 9034, from one fiscal year to the next fiscal year as appropriate based on funding availability and the number of qualified referrals to each provider as long as the total maximum obligation for all SMHS services provided through the County’s integrated system of SMHS does not exceed $7,100,000 per fiscal year; and

9) Authorize the HHSA Director or the Chief Assistant Director, to execute programmatic, administrative, and fiscal documents relating to Agreements 9008, 9031, 9032, 9033, and 9034.

 

FUNDING: 70% Federal Medi-Cal, 1% State Realignment and 29% State Mental Health Services Act (MHSA).

DISCUSSION / BACKGROUND:

The Mental Health Plan (MHP) in each county is responsible for providing or arranging for the provision of SMHS to local residents that are Medi-Cal beneficiaries. Medi-Cal is California’s Medicaid program that provides public health insurance to low-income people, including families with children, seniors, persons with disabilities, foster care, pregnant women, and low-income individuals diagnosed with specific diseases to cover needed health care services. Beneficiaries become eligible for SMHS when an identified mental health condition has a significant impact on the individual’s life functioning.

 

The HHSA Behavioral Health Division (BHD) acts as the MHP for the County of El Dorado and thereby has the obligation to provide eligible children, youth, and young adult residents with access to designated SMHS, in accordance with California Welfare and Institutions Code (WIC) Section 5600 et seq., 14000 et seq., and 17000 et seq. Mandated SMHS programs include outpatient mental health services such as medication therapeutic services, inpatient services such as acute psychiatric hospitalizations, and certain types of residential placements.

 

The four providers presented in this agenda item will provide youth SMHS for County residents that are Medi-Cal beneficiaries and are eligible to receive SMHS because of a mental health condition that has been identified to have a significant impact on their life functions. These clients will be provided high level treatment interventions and supportive services to reach their treatment goals.

 

On May 16, 2024, on behalf of HHSA, the Chief Administrative Office (CAO) Procurement and Contracts (P&C) Division, released Request for Qualifications (RFQ) 24-0051, to solicit responses for the operation of County-wide youth SMHS. Four responses were received which met the RFQ requirements and were deemed qualified to perform youth SMHS by the evaluation panel. On July 15, 2024, CAO P&C posted the RFQ’s resulting Qualified List (QL), determining that the four Respondents (New Morning, Summitview, Stanford and Sierra) were deemed qualified to provide youth SHMS in the County. Subsequently, HHSA staff began developing these agreements for the SMHS, which are similar in form and scope to the attached sample agreements (Attachment A and B), which were approved by both County Counsel and Risk Management.

 

To ensure continuity of the mandated SMHS with no gaps in services, and to ensure the finalized agreements can be executed effective on January 01, 2025, HHSA recommends the Board authorize the Purchasing Agent to execute the finalized competitively procured Agreements 9008, 9031, 9032, 9033, and 9034 utilizing the templates attached to this agenda item. All of these agreements are renewals of agreements which were approved by the Board on August 15, 2023 (Legistar file 23-0985).

 

The sample agreements are being presented to the Board, as the finalized agreements are currently in process and were not ready in time to bring before the Board in this agenda item. Should minor modifications to the sample agreements be necessary (e.g., updates to the rates, standard articles, or other changes), those revisions must be reviewed and approved by County Counsel and Risk Management but will not require another Board approval.

 

ALTERNATIVES:

Should the Board decline to approve these recommendations, HHSA would be unable to maintain compliance with MHP Performance Agreement 6967 executed between the County and the State which could lead to fiscal sanctions.

FINANCIAL IMPACT:

There is no General Fund Cost associated with this agenda item. Sufficient appropriations were Included in the Fiscal Year 2024-25 Budget and will be included in future budgets for the terms of the agreements.
