3) Approve and authorize the Chair to sign Amendment II to Agreement for Services 5531 with Rane Community Development to increase the not-to-exceed amount by $60,000, with no changes to the billable rates, for a total not-to-exceed amount of $150,000; update the Conflict of Interest section; and extend the term to June 30, 2024 for the provision of grant writing, meeting facilitation, and consulting services; and

4) Authorize the Chief Probation Officer and Deputy Chief Probation Officer to execute further documents relating to Agreement 5531, including future amendments which do not increase the maximum dollar amount or term of the Contract, and contingent upon approval by County Counsel and Risk Management.

DISCUSSION / BACKGROUND

Since June 7, 2019, Rane Community Development (Rane) has been providing grant writing, meeting facilitation, and consulting to the Community Corrections Partnership (CCP). Agreement 5531 (Agreement) with Rane was fully executed on March 29, 2021. Amend I to Agreement was approved by the Board of Supervisors on January 3, 2023, with Legistar Item 22-1970, and increased the not to exceed amount of the Agreement.

 

The CCP approved their FY 2023-24 budget on March 2, 2023 (CCP Item 23-0503). Included in the CCP budget is $73,500 for Professional Services, of which $60,000 is slated for Rane.

 

This Amendment II will increase the not-to-exceed amount of Agreement by $60,000 for a total amount of $150,000, extend the term date, and update the Conflict of Services Section to include the California Levine Act Statement.

 

Agreement start date is March 29, 2021, and this item will extend the expiration to June 30, 2024, to expire concurrently with the end of the CCP’s budget year.

 

Due to Amendment II to the Agreement increasing the not to exceed amount above $100,000, a Non-competitive Purchase Request Justification was provided to and approved by Procurements & Contracts. The requested exemption is in accordance with Procurement Policy C-17 Section 3.4, 2(f) "the procurement is for goods where the continuity of providers will provide efficiency or critical knowledge, and other providers of the goods cannot provide similar efficiencies or critical knowledge.”

 

ALTERNATIVES                    

The Board could not approve the amendment and provide direction to Probation to find alternatives for the services Rane provides.

FINANCIAL IMPACT

There is no General Fund impact or increase to Net County Cost for this item. Funding is included in the CCP approved FY 2023-24 budget.
