Transportation Department recommending Chairman be authorized to sign the Certificate of Acceptance for Temporary Construction Easement from Donahue Schriber Realty Group, L.P., for APN's 327-130-54, -56, -62 and -77; and authorize the Director of said Department, or designee, to execute the escrow instructions and any other related escrow documents relating to this transaction, including payment of title and escrow fees.
RECOMMENDED ACTION: Approve.
FUNDING: 2004 General Plan Traffic Mitigation Fee Program (TIM).

Fiscal Impact/Change to Net County Cost:
The U.S. Hwy.50/Missouri Flat Rd. Interchange Project, #71336, Phase 1B project is funded, in part, with TIM funds and sufficient funds are in the project budget for the subject acquisitions, including acquisition costs of $18,900 plus title and escrow fees in the amount of $2,600 for a total of $21,500.
Background:
The U.S. Hwy.50/Missouri Flat Rd. Interchange Project, #71336, Phase 1B, requires those portions of the subject properties be acquired for right of way purposes including a temporary construction easement covering a portion of each of four parcels under the same ownership and contiguous to one another, in order to accommodate the construction of the newly configured West bound off-ramp from U. S. Hwy. 50 to Missouri Flat Rd.
The Temporary Construction Easement covering these four parcels will allow for the placement of compacted fill material and construction of this off-ramp.
Reason for Recommendation:
The temporary land rights are necessary in order to construct Phase 1B of the project.
Action to be taken following Board approval:
1) Chairman to execute the Certificate of Acceptance for the Temporary Construction Easement.
2) Board Clerk to retain a copy of the Temporary Construction Easement, and return the original Temporary Construction Easement with the Certificate of Acceptance to DOT R/W Unit staff.
3) Director of Transportation or designee to sign the Escrow Instructions and any related escrow
documents pertaining to this transaction. All executed documents and all funds necessary to the close of escrow, to be provided to the title company for final audit and recording.
