Department of Transportation recommending the Board:
1) Find that it is appropriate to contract with Department of California Highway Patrol for traffic control services in accordance with Section 3.13.030 (E) of the County Ordinance, because the work is with or among any other governmental entities or agencies; and
2) Retroactively approve and authorize the Chair to sign California Standard Agreement 20R245001 (Fenix 5383) with Department of California Highway Patrol to provide traffic control services on construction projects for a total not-to-exceed of $324,800 and a term beginning January 1, 2021 and ending three years thereafter.
FUNDING: Various funding sources for Capital Improvement Program Projects, including Federal, State and Local funding at different amounts depending on the project.

DISCUSSION / BACKGROUND
During construction on Capital Improvement Program (CIP) projects, lane closures and full road closures are sometimes necessary to ensure motorist and worker safety. During certain closures, such as freeway lane closures, full closures of County roads, weekend closures, and closures under heavy traffic, having California Highway Patrol (CHP) officers on site provides a significant deterrent against reckless driving through construction zones. Additionally, some California Department of Transportation cooperative agreements require that CHP is used for traffic control.
The previous agreement with CHP expired on December 31, 2020 and CHP has stated that the new Agreement start date must be January 1, 2021. The Department of Transportation (Transportation) began working with CHP in March 2020 to get the new Agreement in place, but there were delays at CHP and the new Agreement was not received in time to present for Board approval prior to the start date of the new Agreement. Therefore, Transportation is requesting that the Board approve the Agreement retroactively. There have been no services performed and no money spent under the new Agreement.
Transportation recommends the Board make findings in accordance with County Ordinance Section 3.13.030 that contracting out for this Agreement is appropriate because the work is with or among any other governmental agencies.
ALTERNATIVES
The Board could choose not to approve this agreement. This would preclude Transportation from utilizing CHP to provide enhanced enforcement during lane and road closures implemented by Transportation. CHP's presence at Transportation lane and road closures help improve motorist and worker safety.

FINANCIAL IMPACT
There is no impact to Net County Cost associated with this item, as all projects are funded through sources other than General Fund. It is not anticipated that any expenditures will be made on this contract in the current fiscal year. Funding for future years will be included in Transportation's budget request. Funding for services rendered under this Agreement will be provided by Federal, State and Local funding at different amounts based on individual CIP project budgets.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) Clerk of the Board will obtain the Chair's signature on two (2) originals of the Agreement.
2) Clerk of the Board will forward two (2) signed copies of the Agreement to Chief Administrative Office, Procurement and Contracts Division, for further processing. One (1) fully executed original will be returned to the Board when received from the State.
