Parks, a division of the Chief Administrative Office, recommending the Board:
1) Make findings pursuant to Section 3.13.030 (B) and Section 3.13.030 (C) of the El Dorado County Ordinance, that planning, landscape architecture, and engineering services for the Diamond Springs Community Park project requires specialty skills and qualifications not expressly identified in County classifications and the work is temporary in nature and therefore does not warrant the addition of permanent staff;
2) Approve and authorize the Board Chair to sign Agreement 9120 with Kimley-Horn and Associates, Inc., a firm on the County’s Request for Qualifications 20-918-043 list of qualified firms, to provide planning and engineering services for the development of the Diamond Springs Community Park, for a three-year term and a compensation amount not to exceed $558,700; and
3) Authorize the Purchasing Agent to execute any further documents determined necessary related to Agreement 9120, including amendments which do not increase the amount or term of the Agreement, contingent upon approval by County Counsel and Risk Management.

DISCUSSION / BACKGROUND
In December 2023, the Board formally accepted property from the Marshall Foundation for Community Health for the purpose of developing the Diamond Springs Community Park. The Property was conveyed and dedicated to the County by the Marshall Foundation on the express condition that the Property be used for the development of recreational and park facilities. The deed for this Property restricts use of the Property to recreational and park purposes. At that time the Boys and Girls Club of El Dorado County Western Slope was identified as a community partner to run programs at the site, while under County ownership, representing a public-private partnership.
The Boys and Girls Club seeks to acquire the Property to facilitate the construction and accelerate the timeline for operation of recreational and park facilities. The Boys and Girls Club, a nonprofit organization, also has a robust fundraising program which is intended to be used to leverage funding for construction of the park. On May 21, 2024, the Board declared the property exempt surplus land per Government Code Sections 54220-54234. Staff is also currently processing a rezone of the property to allow the use of the property as a park by right.
The next phase of the project includes site plan refinement and preparation of construction documents for the park, hydrology and hydraulic analysis, retaining wall calculations and 30%, 65% and 100% construction documents, plan review and permitting and construction administration milestones. These engineering deliverables, coupled with landscape architecture phasing and development plans, will provide the detailed design and cost estimates needed for the next project phases, including funding construction. This work program would also include the preparation of technical information and permit applications required for environmental permitting administered by the U.S. Army Corps of Engineers (Section 404 of the Clean Water Act), the California Water Quality Board (Section 401 of the Clean Water Act), and the California Department of Fish and Wildlife (Section 1602 of the California Fish and Game Code).
Utilizing the County’s issued Request for Qualifications (RFQ) 20-918-043 list of qualified firms Category 1A - Land Development Projects, the Division has selected a consultant capable of providing the services required for completion of the planning and engineering services for the project. The Division is requesting to enter into Agreement 9120 with Kimley-Horn and Associates, Inc, for the provision of civil engineering, environmental planning and permitting, landscape architecture and project administration for this phase of the project, with a not-to-exceed amount of $558,700 and a term of three years.
ALTERNATIVES
The Board may choose not to approve the proposed Agreement. This would result in a delay to the development of the Diamond Springs Community Park.

FINANCIAL IMPACT
There is no change to Net County Cost associated with this item. The Board allocated $1 million of Discretionary Transient Occupancy Tax (DTOT) funds with the Fiscal Year 2022-23 Recommended Budget toward the development of the project. The Board directed the funds from the sale of the Bass Lake Property ($250,000) to be set aside and eventually allocated to the Diamond Springs Community Park. The Board allocated an additional $50,000 in General Fund to cover the cost of the CEQA analysis (Legistar file 22-0472), approved the use of $142,372 of the $1 million in DTOT for the amended scope of the Dudek contract (Legistar file 23-0089, April 4, 2023), and approved the use of a portion of the remaining DTOT for the rezone (Legistar file 24-1009). The cost associated with the Kimley Horn contract would be funded by $558,700 of the remaining DTOT funds.
