Fiscal Impact/Change to Net County Cost:  None.  The DDC grant has a 20% County match requirement of $18,532, which is to be covered by in-kind services funded by Substance Abuse Prevention and Treatment (SAPT) Federal Block Grant funding.  However, this amount was estimated at $11,582 in the FY 2009-10 Alcohol/Drug Program budget prior to receipt of Grant Notice; adjustment to FY 2009-10 to accommodate actual match amount will be addressed in the FY 2009-10 Budget Addenda process.  
 
The CDCI grant also has a 20% County match requirement of $18,667 funded by Substance Abuse Prevention and Treatment (SAPT) Federal Block Grant funding.  However, only a portion of this amount was budgeted in FY 2009-10 as the term of the grant begins January 1, 2010; the remainder will be budgeted in FY 2010-11.
 
At the advice of Counsel, Department wishes to advise the Board that this Agreement contains a budget contingency clause for the benefit of the State, allowing cancellation of the Agreement with no provision for compensation of County for services provided (costs incurred) prior to such cancellation / termination of the Agreement for insufficient funding.
 
Background:   The Health Services Department, in collaboration with the Department of Human Services and the El Dorado County Superior Court, oversees the Dependency Drug Court Program which provides treatment for parents whose substance abuse contributes to child abuse and/or neglect resulting in involvement with juvenile court dependency proceedings.  Funding for this program is provided by a CDCI Agreement from the California Department of Alcohol and Drug Programs.
 
Likewise, the Health Services Department, working with the El Dorado Superior Court oversees the Comprehensive Drug Court Implementation program which provides treatment services for adults whose substance abuse results in court proceedings.
 
Reason for Recommendation:  
The Notice of Grant award (DDC-09-10-09) provides funding in the amount of $92,659 for the Dependency Drug Court Program for FY 2009-10.  Approval of this grant notice will allow the County to continue to provide treatment for parents whose substance abuse contributes to child abuse and/or neglect resulting in involvement with juvenile court dependency proceedings.
 
The Notice of Grant award (CDCI 09-10-09) provides funding in the amount of $93,334 for the Comprehensive Drug Court Implementation program for calendar year 2010.  Approval of this grant notice will allow the County to continue providing treatment for adults whose substance abuse has resulted in CDCI court proceedings.
 
Action to be taken following Board approval:
1. Chairman to sign three (3) originals of Agreement DDC-09-10-09; Chairman to sign three (3) originals of Agreement CDCI-09-10-09;
2. Board Clerk's Office to return six (6) signed originals to Department;
3. Department to forward signed originals to State of California Department of Alcohol and Drug Programs for final signature; and
4. Department to return one (1) fully executed Agreement CDCI 09-10-09 and one (1) fully executive Agreement DDC 09-10-09 to Board Clerk upon receipt from the Department of Alcohol & Drug Programs.
