Fiscal Impact/Change to Net County Cost: Funding for the Contract is available in the FY 2006-07 and 2007-08 CSA #10 budget.  There is no cost to the General Fund.  
 
Background: The Environmental Management Department is requesting to enter into a Contract with California Laboratory Services (CLS) to provide analytical analysis of ground, surface and wastewater sampling testing from the Union Mine Landfill (UMLF) and Union Mine Wastewater Treatment Facility (UMWTF).
 
Reason for Recommendation: The Environmental Management Department has previously contracted with California Laboratory Services laboratory testing services associated with the operation and reporting requirements of the Union Mine Disposal Site.  The department desires to continue with the services available from California Laboratory Services and has processed a new agreement for same in an amount not to exceed $200,000.00.    
 
The Union Mine Disposal Site was in a state of emergency for many months in 2006 due to heavy rains experienced during the wet weather season.  In order to abate the emergency status, the department needed to discharge treated effluent into the El Dorado Irrigation District collection systems.  Environmental Management had contracts in place with two other laboratory service providers; however, the El Dorado Irrigation district would not accept the services provided by the other laboratories citing lack of consistent testing and poor data quality control.
 
The Purchasing Agent has coordinated the review of the consultant's qualifications to perform the needed services with Shane Jiang, Environment Compliance Division Manager, El Dorado Irrigation District.   The El Dorado Irrigation District has verified that the contractor is able and qualified to perform the necessary work.
 
The Purchasing Agent concurs that California Laboratory Services has demonstrated its qualifications and ability to perform the work based on prior experience with this firm; responsiveness to Environmental Management's requests, accurate and consistent test results and the provision of courier services to pick up samples that are not otherwise available from other service providers.  
 
The County Purchasing Agent has reviewed the Department's request to contract with California Laboratory Services and concurs that the continued use of this consultant is appropriate and that the Department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.  
 
This Contract has been approved by County Counsel and Risk Management, is for an amount not to exceed $200,000, and shall expire two years from the date of execution.
The County Officer or employee with responsibility for administering this Contract is Gerri Silva, Director of Environmental Management.
 
 
Action to be taken following Board approval: Upon execution by the Chair, the Board Clerk's Office will forward copies of the Contract to Environmental Management for distribution, encumbrance, and administration.
