Title

Health and Human Services Agency (HHSA) recommending the Board:

1) Approve the attached revised Psychiatric Health Facility (PHF) Template Revenue Generating Agreement (Attachment A) that allows other counties to contract with the County of El Dorado for the provision of acute inpatient mental health services for clients they refer to the County PHF;

FUNDING: 100% Fees-for-service revenue provided to County from other local government agencies.

DISCUSSION / BACKGROUND:

The El Dorado County (County) Psychiatric Health Facility, operated by Telecare Corporation, Inc. is a secure 16-bed facility that provides intensive mental health and psychiatric treatment services to admitted clients in a safe, welcoming environment. Clients admitted to the County’s PHF are adults, ages 18 and over, that are experiencing a mental health emergency.

 

HHSA has contracted with other counties for many years to provide access to the County's PHF and for the provision of mental health services for their clients who require acute inpatient mental health services and are eligible for these services. The services provided by the County PHF include psychiatry, medication, clinical treatment, nursing, and the required documentation and maintenance of health information in accordance with prevailing federal and state laws and regulations. Accepting clients from other counties helps HHSA to maximize revenues and offset fixed operational costs of the PHF, while assisting other counties with their mandated mental health services. In addition, to ensure availability of PHF beds for County Clients, the County retains the exclusive right of refusal for referrals from other counties.

 

On January 25, 2022, the Board approved the PHF Agreement Template and adopted Resolution 015-2022, which permitted the HHSA Director, or designee, to execute PHF agreements with other counties utilizing this template for the provision of acute inpatient mental health services for clients they refer to the County PHF (Legistar file 21-1883).

 

HHSA has worked with County Counsel to revise the PHF Template Agreement to include updated Term and Maximum Obligation Articles, and additional standard contract language to accurately reflect the applicable terms and conditions when contracting out the PHF services. Should further minor modifications to the PHF Template Agreement be necessary (e.g., revisions to comply with regulation updates, update or addition of standard contract articles, or other changes suggested by County Counsel or Risk Management), those revisions must be reviewed and approved by County Counsel and Risk Management but will not require Board approval. If changes to the services provided by the County PHF occur, or upon advisement by County Counsel, a new PHF Template Agreement will be brought to the Board for approval.

 

HHSA is recommending the Board adopt and authorize the Chair to sign the attached Resolution, superseding and replacing Resolution 015-2022 which authorizes use of the revised PHF Template Agreement.

 

ALTERNATIVES:

Should the Board decline to approve this recommendation, HHSA will continue utilizing the current Board approved PHF Template to enter into agreements with other counties, however there will be outdated contract language in those agreements.

FINANCIAL IMPACT:

There is no Net County Cost associated with the agenda item as this request is for a boilerplate/template agreement that will generate revenue. The Use of PHF Agreements helps offset the cost of PHF operations, saving on Behavioral Health Realignment funds.
