Chief Administrative Office, Procurement and Contracts Division, recommending the Board of Supervisors:

1) Find and declare that the donation of a surplus vehicle, 1996 Ford Van (License 041851), will be used in a manner that is beneficial to the public good; and

DISCUSSION/BACKGROUND

In accordance with the Purchasing Ordinance as noted in Section 3.12.220 of the El Dorado County Code of Ordinances, upon the recommendation of the purchasing agent that specific items of property belonging to the County and found by the Board of Supervisors not to be required or adequate for County use, the Board of Supervisors may make available to community based organizations engaged in the pursuit of public purposes those items of surplus personal property.  The transfer of personal property to such organizations shall be made in accordance with Government Code sections 25372(a)(5) and pursuant to a written agreement.

 

At their October 30, 2018 meeting, a 1996 Ford 12-Passenger Van (County Tag #503590) was designated by the Board as surplus to the County's needs (Item 8, File 18-1614). Government Code, Section 25372 et seq. provides the authority for the Board to donate or lease any real or personal property that it declares to be surplus to certain agencies and jurisdictions. This applies to organizations exempt from taxation pursuant to Section 501(c)(3) of the Internal Revenue Code Section 501(c)(3) of the Internal Revenue Code that is organized to provide health or human services.

 

In early November of 2018, Don Vanderkar of Hangtown Haven Inc., a non-profit 501(c)(3) organization, reached out to Supervisor Hidahl to request that the County donate the van to Hangtown Haven. The organization meets the requirements of Government Code Section 25372 (b)(5) and plans to utilize the van to transport the homeless to nomadic shelters and/or doctor appointments.  As the current Chairman of the Board of the organization, Mr. Vanderkar has affirmed that he is authorized to sign the donation agreement and take ownership of the vehicle.  A copy of the Surplus Form indicating the vehicle description is attached to this agenda item.

 

ALTERNATIVES

The Board could choose not to donate the vehicle, and the Purchasing Agent would dispose of the surplus property by direct sale or auction.

 

PRIOR BOARD ACTION

At the Board of Supervisors meeting on October 30, 2018 (Item 8, File 18-1614), One (1) 1996 Ford Van (License #041751) was approved as county surplus property in accordance with the procedures outlined in the County's Purchasing Ordinance, Chapter 3.12 and Section 3.12.220

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

The vehicle has been declared surplus, and if not donated, would be auctioned for sale. Therefore, the value of the van is difficult to determine. The donation of the item does not result in any material fiscal impact.
