Health and Human Services Agency (HHSA) recommending the Board:
1) Make findings pursuant to El Dorado County Ordinance Chapter 3.13, Contracting Out, that the Mental Health Rehabilitation Center services provided by Mental Health Management I, Inc. doing business as Canyon Manor (Canyon Manor) requires specialty skills and qualifications not expressly identified in County classifications are involved in the performance of the work;
2) Make findings in accordance with Procurement Policy C-17 Section 3.4(2f) exempting the competitive bidding process, with Purchasing Agent concurrence, because “the procurement is for services where the continuity of providers will provide efficiency or critical knowledge, and other providers of the services cannot provide similar efficiencies or critical knowledge”;
3) Approve and authorize the Chair to sign Agreement for Services 9477 with Canyon Manor, in the amount of $2,000,000, and for the term of three years from July 1, 2025, through June 30, 2028;
4) Authorize the Purchasing Agent to execute amendments relating to Agreement 9477, contingent upon approval by County Counsel and Risk Management, which do not increase the maximum dollar amount or term of the Agreement; and
5) Authorize the HHSA Director, or the Chief Assistant Director, to execute programmatic, administrative, and fiscal documents relating to Agreement 9477.

DISCUSSION / BACKGROUND:
HHSA contracts with the State of California to serve as the Medi-Cal Mental Health Plan (MHP) in El Dorado County. As the MHP, HHSA is responsible for providing Specialty Mental Health Services (SMHS) to eligible individuals, which includes long-term residential facility placements when clinically appropriate. To fulfill this responsibility, the MHP contracts with providers of Mental Health Rehabilitation Center (MHRC) facilities, ensuring these services are available on an "as requested" basis in accordance with Title 9 and Title 22 of the California Code of Regulations and Division 5, Chapter 5 of the California Welfare and Institutions Code (WIC).
Canyon Manor operates a state-licensed facility that provides MHRC services to adults with serious mental illness (SMI). County has had a contract with Canyon Manor since 2016 to provide these services. Canyon Manor, located in Marin County, is a 24/7 state-licensed 89-bed MHRC facility. The facility offers long-term care for eligible clients whose SMI requires continuous supervision, serving as an alternative to state hospital placements for individuals who meet the eligibility criteria established by the California Department of Health Care Services. The services provided are designed to assist clients in developing the skills necessary for greater self-sufficiency and independent functioning, with the ultimate goal of community reintegration.
HHSA’s Behavioral Health Division and Public Guardian clients, aged 18 or older who meet the criteria for SMHS as outlined in Section 14184.402 of the WIC, may be referred to Canyon Manor to receive MHRC services outlined in proposed Agreement 9477. This proposed agreement with Canyon Manor is a renewal of Agreement 6253, which was approved by the Board on March 22, 2022 (Legistar file 22-0371), to ensure the uninterrupted continuation of essential MHRC services.
In accordance with Board of Supervisors Procurement Policy C-17, HHSA recommends this agreement be exempt from competitive bidding, with Purchasing Agent concurrence, per Section 3.4(2f) as "the procurement is for services where the continuity of providers will provide efficiency or critical knowledge, and other providers of the services cannot provide similar efficiencies or critical knowledge." The need for these services in El Dorado County far outweighs the availability of beds, HHSA contracts with as many qualified vendors as possible to provide residential services to Medi-Cal beneficiaries residing in El Dorado County. HHSA seeks to maintain existing residential contracts in place to ensure client/clinician continuity of care.
ALTERNATIVES:
Should the Board decline to approve this recommendation, HHSA will continue to provide MHRC services through existing contracts but would be limited in its access to these types of facilities. Subsequently, the County would have diminished capacity to provide services required of the MHP. Additionally, the continuity of care for the two clients currently placed at Canyon Manor would be disrupted.

FINANCIAL IMPACT:
There is no Net County Cost associated with this agenda item. Sufficient appropriations were included in the Fiscal Year 2025-26 Budget and will be included in future budgets for the term of the Agreement.
