1) Adopt and authorize the Chair to sign Resolution of Intention 068-2019 to amend the County General Plan by updating the Public Health, Safety, and Noise Element to be completed by 2021 as required by State law; and

2) Direct staff to take steps necessary to prepare, in a manner consistent with applicable law, codes and regulations, a Public Health, Safety, and Noise Element Update. (Est. Time: 10 Min.)

DISCUSSION / BACKGROUND

The Public Health, Safety and Noise Element is one of the seven General Plan Elements mandated by the State of California, as required in Government Code Section 65302(g)(3) and (g)(4).

 

Section 65302 (g)(3) states: Upon the next revision of the housing element on or after January 1, 2014, the safety element shall be reviewed and updated as necessary to address the risk of fire for land classified as state responsibility areas, as defined in Section 4102 of the Public Resources Code, and land classified as very high fire hazard severity zones, as defined in Section 51177.

 

Section 65302 (g)(4) states: Upon the next revision of a local hazard mitigation plan, adopted in accordance with the federal Disaster Mitigation Act of 2000 (Public Law 106-390), on or after January 1, 2017, or, if a local jurisdiction has not adopted a local hazard mitigation plan, beginning on or before January 1, 2022, the safety element shall be reviewed and updated as necessary to address climate adaptation and resiliency strategies applicable to the city or county.

 

The County’s Office of Emergency Services has been working on updating the County’s local hazard mitigation plan, and has forwarded their recommendation to the Federal Emergency Management Agency for its review and approval.

 

On September 18, 2018, the Board adopted Resolution of Intention 193-2018 to amend the County General Plan by updating the Housing Element in 2021. The 2021 Housing Element Update will cover the eight-year period from August 31, 2021 through August 31, 2029.

PRIOR BOARD ACTION

The Public Health, Safety, and Noise Element has been amended three times by 2004 General Plan Board Resolutions: No. 062-2009 adopted March 24, 2009; No. 238-2014 adopted December 16, 2014, and No. 196-2015 adopted December 15, 2015.

The update of the Safety Element will involve coordinating with several County departments, districts, and councils; State/Federal agencies; and regional planning agencies including but not limited to: County Departments, Districts, and Councils: Office of Emergency Services; Chief Administrative Office; Department of Transportation; El Dorado County Air Quality Management District; Environmental Management; Sheriff’s Department; Fire Safe Councils; State Agencies: Air Resources Board; Board of Forestry and Fire Protection; Department of Forestry and Fire Protection; Caltrans; Department of Conservation; Department of Veteran’s Affairs; Department of Water Resources; Health and Human Services Agency; Housing, Community and Economic Development; Federal Agencies:  Environmental Protection Agency; Federal Housing Administration; Federal Emergency Management Agency; U.S. Bureau of Land Management; U.S. Department of Housing and Urban Development; U.S. Forest Service; Regional Planning Agencies: Sacramento Area Council of Governments; and Tahoe Regional Planning Agency.

 

CAO RECOMMENDATION/ COMMENTS

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

Staff is recommending hiring a consultant to undertake this two-year long effort. Project details will be developed and staff will return to the Board with a proposed contract for execution. An estimated budget of $50,000 is included in Department's Fiscal Year 2019-20 budget request for the first part of the consultant contract. The total estimated cost for a consultant's work on the project is $150,000.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board will obtain the Chair's signature on the Resolution of Intention.
2) Clerk of the Board will forward one (1) certified copy of the signed Resolution of Intention to the Planning and Building Department, Planning Services, Long Range Planning Unit, attention of Michael Nihan.
