DISCUSSION / BACKGROUND
Since June of 2006, the California Department of Corrections and Rehabilitation, Division of Juvenile Justice (CDCR/DJJ) has provided diagnostic studies, treatment services, and temporary detention for delinquent youth referred in Juvenile Court

A Juvenile Court determines if a delinquent youth is eligible for commitment to the CDCR/DJJ, in any county in which there is a contract in effect, pursuant to Section 1752.1 and Section 1731.6 of the Welfare and Institutions Code (WIC). The Juvenile Court also determines if a delinquent youth is eligible for commitment by ensuring the youth falls within the provisions of WIC Section 1731.5, and concludes that a proper disposition of the youth’s case requires such observation and diagnosis as can be made by the CDCR/DJJ.

The current agreement between CDCR/DJJ and the Probation Department (Probation) expires on June 30, 2020, and a new agreement will be effective July 1, 2020. Probation has been working with CDCR/DJJ on the new agreement since January 28, 2020. The CDCR/DJJ is the lead agency for the new agreement. Due to the current situation revolving around COVID-19, Probation received communication from CDCR/DJJ on April 7, 2020, acknowledging a delay in the status of the contract, and that it was uncertain how their contracts were going to be moved forward.
