Fiscal Impact/Change to Net County Cost: Costs for these services are budgeted in the District Attorney's annual budget. Every year funds are collected by the courts and then journaled over to a trust account held by the District Attorney's office. These funds are to be used to offset the cost of blood draw and urine analysis done by the Department of Justice. Historically funds received by the court do not cover the full cost of the analysis. The Department absorbs whatever cost is not captured through the court ordered fees. It is estimated that the revenue received through court ordered fines will be $32,000 for fiscal year 2010/2011 resulting in a net county cost of $8,680.

Reason for Recommendation: This agreement with the Department of Justice was originally effective March 1, 2005. The perpetual agreement is being brought before the Board to authorize continuation of the agreement for another 12 month period.

A copy of the agreement signature page is attached along with Exhibit A. Exhibit A defines the scope of services, including blood and urine laboratory examinations and related services.
