DISCUSSION / BACKGROUND
At the request of several Special Districts, the Board of Supervisors established development impact mitigation fees. The County collects, holds, and distributes these fees on behalf of the individual Districts. Since the Districts do not have the authority to impose such fees independently, the Board voluntarily adopted them, taking on the responsibility of compliance with the reporting requirements outlined in the Mitigation Fee Act ("Act").
Under the Act, the Board must issue annual reports and make specific findings every five years following the first deposit of fees. The attached reports contain the required fiscal information, as mandated by Section 66006 of the Act, which must be made public annually. For Fiscal Year 2023-24, no five-year findings are due from any Districts.
While this information has been posted on the County's webpage https://www.eldoradocounty.ca.gov/Land-Use/Planning-and-Building/Planning-Division/Planning-Fees/AB-1483-Reporting and available in the office of the Clerk of the Board, the Act further requires that the Board of Supervisors review the report no less than 15 days after it has been made public.
