Auditor-Controller recommending the Board:
1) Make findings in accordance with Section 3.13.030 (B) of the County Ordinance that specialty skills and qualifications not expressly identified in County classifications are involved in the performance of the work; and
2) Approve and authorize chair to sign this agreement with Calfee & Konwinski for three years covering the period of October 18, 2024 through October 17, 2027 for a not to exceed amount of $90,000.00. This agreement will allow the consultant to continue to provide legal services related to the preparation of legal proceedings regarding the collections of delinquent special taxes for special assessment districts.

DISCUSSION / BACKGROUND
Calfee & Konwinski has been authorized by this Board to initiate foreclosure proceedings on parcels in the multiple special assessment districts since October 2006. In accordance with various bond indentures and County practice, the Auditor-Controller’s Office has assumed the responsibility of pursuing judicial foreclosures on parcels that are delinquent in paying special taxes in the various special assessment districts. Calfee & Konwinski has the unique ability to provide legal services relative to the preparation of legal proceedings regarding the collection of delinquent special taxes for special assessment and Mello Roos districts. Calfee & Konwinski has in place programs, equipment, and personnel to deliver these specialty legal services.
