Department of Transportation recommending the Board:
1) Accept the road improvements for Black Rice Road for Benefit of Diamond Village Apartments, PD 17-0002, as complete;
2) Reduce Performance Bond 800148751 from $666,232.72 to $66,623.27, which is ten percent of the total cost of the road improvements. This amount guarantees against any defective work, labor done, or defective materials furnished, which is to be released after one year if no claims are made;
3) Hold Laborers & Materialmens Bond 800148751 in the amount of $666,232.72 for six months to guarantee payments to persons furnishing labor, materials, or equipment; and
4) Authorize the Clerk of the Board to release the respective Bonds after the required time periods upon written request by Transportation.

DISCUSSION / BACKGROUND
Planned Development PD 17-0002 for the Diamond Village Apartments project (Project) was approved by the Board of Supervisors on August 14, 2018 (Legistar file 18-1133 & 18-1136). On September 19, 2023 (Legistar file 23-1491), the Board approved the Offsite Road Improvements for Black Rice Road for Benefit of Diamond Village Apartments, PD 17-0002, Agreement #22-55028 (RIA), between the County and Diamond Village Apartments, LP (Developer).
The RIA defined the obligations of the Developer for the performance of the work within the County Right of Way. The RIA set forth the terms and conditions for the construction of the offsite improvements and allowed the Developer to construct improvements to Black Rice Road from the intersection of State Route (SR) 49 eastward, including Class 2 bike lanes in each direction and a connection with Happy Lane, as well as an extension to Racquet Way north to complete the connection with Black Rice Road, in accordance with approved plans.
