Chief Administrative Office, Facilities Division, recommending the Board authorize the Purchasing Agent to sign Amendment III to the Facility Use Agreement (FUA) 957-O0810 (FENIX Agreement 1028) with South Tahoe Public Utility District (STPUD) for an additional five-year term from July 1, 2023 to June 30, 2028, for real property known as Building B, including exterior area, located at 1834 Santa Fe Road, Tahoe Paradise, for the Sheriff's Search and Rescue Station, for no cost.

DISCUSSION / BACKGROUND
On July 29, 2008, with Legistar Item 08-1122, the Board approved FUA 957-O0810 with STPUD for the Sheriff's Office to establish a Search and Rescue Station at the real property known as Building B, including exterior area, located at 1834 Santa Fe Road, Tahoe Paradise for a term from June 30, 2008 to June 30, 2013. Amendment I was signed by the Board on June 4, 2013, with Legistar Item 08-1122, which amended Section 10 to extend the term for an additional five years until June 30, 2018. On May 8, 2018, with Legistar Item 18-0682, the Board approved Amendment II which extended the term for an additional five years until June 30, 2023.
Amendment III would extend the term from July 1, 2023 to June 30, 2028. It would also include ancillary updates to Section 11: Insurance Requirements; Section 13: Notices; and Section 20 (to update name of Facilities Division Manager). The Amendment would add Section 29: Electronic Signatures.
ALTERNATIVES
The Board could not approve Amendment III and the Sheriff’s Office would need to find another facility for the Search and Rescue Station possibly at higher cost since this facility is being provided at no cost.
