Title: Health and Human Services Agency, Public Health Division, recommending the Board consider the following: 1) Authorize the Chair to sign retroactive and perpetual Agreement for Services 012-S1411 with Pharmpak, Inc. in the annual not-to-exceed amount of $3,000 for the term beginning July 1, 2013 until terminated by either party for the provision of pharmaceutical purchases and relabeling of pharmaceutical products on an “as needed” basis for treatment or prevention of communicable disease; and 2) Chief Administrative Officer or designee to execute further documents relating to Agreement for Services 012-S1411, including amendments thereto, contingent upon approval by County Counsel and Risk Management, which do not affect the maximum dollar amount or term of the Agreement. Retroactive Term
Agreement is retroactive due to longer than anticipated negotiations with Contractor regarding appropriate insurance documentation and development of updated wording in the Scope of Services necessitated by County Counsel and Program.

Background
Health and Human Services Agency (“HHSA”) has successfully contracted with Pharmpak for several years on an “as needed” basis for the purchase of repackaged pharmaceutical drugs from Contractor’s Master Formulary; the repackaging of bulk pharmaceutical drugs provided by County and labeled to its specification pursuant to Federal regulations and in compliance with California Pharmacy law; and providing over-the-counter medications, diagnostic kits, and devices as requested by the County.
