DISCUSSION / BACKGROUND
County Charter section 403 states, “The Board of Supervisors shall appoint a County Counsel who shall have the same duties as a County Counsel appointed under the general law. The County Counsel shall serve for four years from the time of appointment. The four-year term shall commence eighteen months after each Presidential election.”

At least ninety days prior to the end of a term, the Board of Supervisors shall notify the incumbent County Counsel if he or she will be appointed to a successive term. If such notification is given, the successive term will commence immediately upon completion of the prior term.

County Counsel’s current term ends on May 4, 2026, so the Board must notify Mr. Livingston of its intent no later than February 3, 2026.

Mr. Livingston is currently at the top step (Step 5) of the salary schedule so there are no recommended changes to compensation based on this Board action.

ALTERNATIVES
The Board could choose not to reappoint Mr. Livingston. If the Board chooses not to appoint Mr. Livingston to a new term, staff will immediately begin a recruitment for a new County Counsel prior to the end of Mr. Livingston’s term on May 4, 2026

FINANCIAL IMPACT
Because Mr. Livingston is already at Step 5 of the salary schedule, there would be no financial impact to his reappointment since the Salary and Benefits for County Counsel have been included in the FY 2025-26 budget.
