Title: Chief Administrative Office, Facilities Division, recommending the Board consider the following: 1) Authorize the Purchasing Agent to sign Facility Use Agreement 6219 with the El Dorado County Chapter of the California Native Plant Society, a non-profit organization, to allow for the use of County property at three locations; the Foyer between 330 and 360 Fair Lane (Buildings A & B), the outdoor covered entrance area and lawns on either side of the entrance at 2850 Fair Lane Court (Building C), and the middle parking lot and grass area of Bldg. C, for the purpose of hosting the semi-annual plant sales scheduled for October and April every year, effective upon execution for a term of five years; and 2) Authorize the Purchasing Agent, or designee, to execute further documents relating to Facility Use Agreement 6219 including future options and amendments contingent upon approval by County Counsel and Risk Management. Body
The El Dorado Chapter of the California Native Plant Society (CNPS) is an active organization promoting the use of plants native to the County since 1993. The parent organization is a California Non-Profit Corporation duly qualified to conduct business in California. The El Dorado County chapter works to protect and teach about all native plants in the County, from rare to common. The CNPS plant sales provide community access to a large selection of native plants and the chapter has offered free talks, native garden tours and also acts as a watchdog for county development, trying to ensure that protections in place are actually followed.
Pursuant to Section 5.10.060 of the County Property Vending Licenses Ordinance, charitable nonprofit organizations are exempt from the vending license application process if the vendor is a charitable and/or nonprofit organization, the vendor will not use the County property beyond a period of one day, two times per year; and the use will not violate any zoning or health laws or regulations....
