Title
Chief Administrative Office recommending Resolution amending Resolution 049-2007 for the Public Safety Impact Fee Program to clarify the calculation and payment conditions in the original resolution.
RECOMMENDED ACTION:  Adopt resolution 113-2007.

Background:  On February 27, 2007 the Board adopted Resolution 049-2007 setting new public safety impact fees for new development effective April 30, 2007.
 
Subsequent to the adoption of the resolution, staff from Development Services identified points of clarification that needed to be made in order to implement the new fee.  After discussions with County Counsel and the Auditor-Controller, it was agreed that a new resolution to amend the original resolution should be presented to the Board to allow for clear and consistent application of the new fee.
 
Reason for Recommendation:  In order to ensure clear consistent and application of the new fee, staff recommends the Board adopt a new resolution to amend the original resolution.  The new resolution has no impact on the amount of the fees, but includes revisions to clarify the following:
 
§      The fee applicable to any development shall be determined in accordance with the fee schedule in effect on the date the application for building permit is deemed complete, and shall be paid upon issuance of the building permit
§ Conversion of the unit basis from 1000 square feet to "per square foot" cost
§ Land use classifications will be determined by the Director of Development Services or designee as they apply to occupancies in the California Building Code
 
Changes to the original resolution are limited to Section 3.  Copies of the original Resolution 049-2007, the revised resolution showing the changes, and the final revised resolution are attached.
 
Action to be taken following Board approval:  Development Services staff will implement and apply the fees where applicable.
