Transportation Department recommending Chairman be authorized to sign the Easement Acquisition Agreement For Public Purposes and Certificate of Acceptance for the temporary construction easement from Thomas Van Noord, Trustee for APNs 109-240-08 and 109-030-33; and Director of said Department or designee be authorized to execute the escrow instructions and any other related escrow documents for this transaction, including payment of title and escrow fees for the Durock Road/Business Drive Signalization Project 73354.
RECOMMENDED ACTION: Approve.

Fiscal Impact/Change to Net County Cost:
Sufficient funds are appropriated to provide for the proposed acquisition, including compensation to the owner in the amount of $1,000 plus title and escrow fees of approximately $1,500, for a total of $2,500. The acquisition costs will be funded through TIM fees. There is no net cost to the County General Fund associated with this item.
Background:
The Durock Road/Business Drive Signalization Project (#73354) requires a temporary construction and utility easement to PG&E in order to construct the roadway and signalization improvements.
On April 22, 2008, your Board authorized DOT’s Right of Way Unit to proceed with negotiations to acquire land rights affecting portions of the subject parcels. Negotiations with Thomas Van Noord have concluded and a settlement reached that is representative of the appraised value of the necessary land rights.
Reason for Recommendation:
The land rights being conveyed are necessary for the construction of the Durock Road/Business Drive Signalization Project.
