RECOMMENDED ACTION:  Planning Commission recommending the Board take the following action:  1.  Adopt the negative declaration, as prepared; 2. Approve Z06-0042/PD06-0027 rezoning Assessor's Parcel Number 083-456-10 from Commercial (C) to Commercial-Planned Development (C-PD), adopting the development as the official development plan, based on the findings and subject to the conditions listed on Attachment 1; and 3.  Approve DR90-0031R based on the findings and subject to the conditions listed on Attachment 1.
 
Background: These applications were considered by the Planning Commission on April 26, 2007, and unanimously recommended for approval. The Planning Commission approved the minor (one percent) increase in the floor area ratio (25 to 26 percent) based on staff's discussion of the County's proposed increases to FAR from 25 to 85 percent.  Subsequent to approval of this project, the Commission recommended the increased FAR to the Board of Supervisors. The applicant's representative described the project. No one from the audience gave input.  There were no new significant issues discussed other than those in the staff report.
