DISCUSSION / BACKGROUND
A request has been submitted by El Dorado RV Resort & Campground LLC, a California limited liability company, owners of Assessor Parcel Number 327-120-019, 327-120-020, 327-120-021, 327-120-022, requesting that the County of El Dorado, Board of Supervisors, vacate the entirety of the 50’ non-exclusive road and public utility easement encumbering Parcels 1, 2, 3, and 4 and the entirety of the 25’ drainage easement encumbering Parcels 1, and 2. The easements are more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.
The 50’ non-exclusive road and public utility easement, as shown on Parcels 1, 2, 3, and 4 of Parcel Maps Book 16 Page 6, and the 25’ drainage easement shown on Parcels 1 and 2 of said map, were created by Fico Inc., on June 28th, 1977. The easements were never offered, therefore they were neither rejected nor accepted by the County of El Dorado, and the map recorded on June 28th, 1977.
Department of Transportation, AT&T, Comcast, El Dorado Irrigation District, Pacific Gas & Electric have not used said 50’ non-exclusive road and public utility easement, or the 25’ drainage easement for the purposes for which they were dedicated and find no present or future need exists for said easements and do not object to their vacation, and to that end, have all issued letters to that effect.
