DISCUSSION / BACKGROUND
A request has been submitted by Matthew Bensley and Claudia L. Carbonell-Bensley, husband and wife as joint tenants, owner of Assessor's Parcel Number 125-636-004, requesting that the County of El Dorado, Board of Supervisors, vacate a public utility easement located on said property. Subject easement is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.
The public utility easement, as shown on Lot 35 of Oak Tree Village Unit 1, recorded in Book G at Page 84, was offered to the County of El Dorado by Oak Tree Village Joint Venture, A California General Partnership, on November 30, 1987. The easement was acknowledged and accepted by the County of El Dorado on December 22, 1987, and the Subdivision Map was recorded on December 28, 1987.
ALTERNATIVES
An alternative would be to not adopt a Resolution of Vacation for Abandonment of Easement 20-0004. By utilizing this alternative, the owner of Assessor's Parcel 125-636-004 would be unable to pursue any development that would impact subject easement.

OTHER DEPARTMENT / AGENCY INVOLVEMENT
AT&T, Comcast, El Dorado Irrigation District, and Pacific Gas & Electric have not used said portion of subject easement for the purpose for which it was dedicated and find no present or future need exists for said portion of subject easement and do not object to its vacation, and to that end, have all issued letters to that effect.
