DISCUSSION / BACKGROUND
On January 5, 2016 (Item 21), the Board approved the Road Improvement Agreement for Mercy Housing Sunset Lane Apartments, Offsite Improvements AGMT 13-53705 with Mercy Housing California 55 (Owner). The first amendment to AGMT 13-53705 (Amendment) was delayed which resulted in a lapse of the performance period. In order to correct the lapse, staff is requesting a two year performance period extension to extend the performance period to January 4, 2020.
The construction of this subdivision is substantially complete and this extension will allow the Owner time to complete any remaining items and finalize the project.

1) The Clerk of the Board will obtain the Chair’s signature on two (2) originals of the Amendment with Mercy Housing California 55.
2) The Clerk of the Board will forward one (1) signed original Amendment to the Chief Administrative Office’s, Procurement and Contracts Division, for further processing.
