Supervisor Briggs recommending the Board authorize the Chair to sign the "Agreement for Use of Grassy Run Community Services District Funds" between the County of El Dorado and the Grassy Run Community Services District.
Body
The Grassy Run Community Services District (District) was established in 1982 to provide road and road maintenance services for the road system servicing the parcels located within the 445 acres that comprise the District.  In June 1997 the District adopted Resolution No. 97-2, resolving that the District would no longer spend District funds on the roads within the Grassy Run Community Services District; no funds have been spent for that purpose since that time.
 
On February 24, 2011, the District adopted Resolution No.11-01 to petition the El Dorado Local Agency Formation Commission (LAFCO) to issue an Order, Decision or Ruling to dissolve the District. LAFCO accepted the District's petition on April 14, 2011, and assigned the petition for dissolution LAFCO Project No. 2011-04.  On August 2, 2011, the County of El Dorado adopted Resolution No. 134-2011 to declare its support for LAFCO Project No. 2011-04.
 
LAFCO Project No. 2011-04, Dissolution of the Grassy Run Community Services District, is currently scheduled for hearing before the Local Agency Formation Commission on Wednesday, December 7, 2011.  Upon dissolution, and after the payment of all costs incurred in connection with the dissolution, the District will have a remaining fund balance.  After consultation with LAFCO and the County of El Dorado, the District has agreed to transfer the remaining fund balance to the County on the condition that the County spend the funds on purposes authorized within the "Agreement for Use of Grassy Run Community Services District Funds."
