DISCUSSION / BACKGROUND
The Treasurer-Tax Collector Department has contracted under the current perpetual agreement with Loomis Armored US, LLC, for the provision of secured pickup and delivery services since 2018. In March 2022, Loomis notified customers of a California Supplemental Paid Sick Leave five percent surcharge that they would be applying to invoices for April 2022 through September 2022 to help offset their costs under the program.

As the imposition of the surcharge is not allowed under the current contract with El Dorado County, this department began at that time to negotiate a contract amendment. Since both the County and Loomis’ standard contract language had experienced major revisions since the current perpetual contact had been executed in 2018, substantial negotiations were necessary in order to reach an agreement for amendments to the contract.

The retroactive status of this item is due to those lengthy negotiations. The contract remains perpetual with no change to the start or end date. This amendment will allow retroactive payments of the five percent surcharge back to April 2022. The contract that was in place in April did not allow such payments. It should be noted that the total retroactive amount payable to Loomis should the Board approve this amendment is anticipated to be approximately $162.00 for the term of April 2022 through September 2022.

ALTERNATIVES
The Board could choose not to approve this retroactive amendment. If so, the Department would then need to issue a Request for Proposal and contract with a new armored car company. This can be a lengthy process and leave the Department without secured pickup and delivery ...
