Background:
A partial owner of Agricultural Preserve #11 (Shirley Rose) has requested that the County initiate the non-renewel of Williamson Act Contract #11 because the property under contract no longer meets the minimum income requirements to remain in a Williamson Act Contract with the County. The original contract consisted of 43 acres of orchards and 226 acres of grazing land. A letter provided by the Agricultural Commission to Planning Services (attached) states that one of the property owners under Contract #11 (Alice Clary) has informed the Commission that due to extenuating circumstances, the walnut orchards do not meet the minimum income requirements of $13,500. The other properties within Williamson Act Contract #11 are not being used for grazing land. The properties under contract total 282.47 acres, comprising of Assessor's Parcel Numbers 093-032-37, 38, 62, 63, & 72. The parcels are accessed from both Perry Creek and Klare Road and are located in the Fairplay area (Supervisorial District II).
Reason for Recommendation:
Board of Supervisors Policy C-12 establishes procedures for processing Notices of Non-Renewel. In accordance with Policy C-12 the Notice of Non-Renewel was received by the County Recorder October 4, 2006 (Document No. 20060068047).
