Community Development Agency, Transportation Division, recommending the Board approve and authorize the Chair to sign the Bike Path Improvement Agreement for West Valley Village (Blackstone) Class I Bike/Pedestrian Trail Phase 1 and 2 AGMT 14-53912 with West Valley, LLC. Condition No. 61 of the Valley View Specific Plan Conditions requires the Developer to construct the Class I Bike/Pedestrian Trail.

DEPARTMENT RECOMMENDATION
The Transportation Division recommends the Board approve this Agreement in order to comply with Condition No. 61 of the Valley View Specific Plan and to compel the Developer to complete the West Valley Village (Blackstone) Class I Bike/Pedestrian Trail Phase 1 and 2.
DISCUSSION / BACKGROUND
On January 22, 2004, the Owner obtained approval of the tentative map TM99-1359 subsequently amended July 2, 2004 as TM99-1359R, West Valley Village project now commonly referred to as “Blackstone”. Condition of Approval No. 61 for the development of the project requires the construction of a Class I bicycle and pedestrian trail along the portion of Latrobe Road adjacent to the project site consistent with El Dorado County and El Dorado Hills Community Services District Standards.
There have been ongoing discussions concerning the timing and manner for construction of the West Valley Village (aka Blackstone) Class 1 Bike/Pedestrian Trail (Trail) between the Owner and the County. The parties desire to enter into this Agreement to set the timing and manner of construction of the Trail and to specify the security for construction of the Trail to be posted by the Owner.
The Trail is scheduled to be completed in two phases. This Agreement includes the plans to complete Phase 1 which runs along Latrobe Road from the El Dorado Hills Waste Water Treatment Plant to the southerly end of West Valley Village Unit 2 at Larkstone Place.
