DISCUSSION / BACKGROUND
To further efficiencies and provide an often-suggested avenue for participation and engagement, staff has reviewed the County Property Vending Licenses Ordinance, which regulates the use of County property by vendors. The current ordinance requires a lengthy competitive process for all vendors other than nonprofits or charitable organizations. If a vendor approaches the County or if staff identifies a need for an outside vendor on County property, currently, the Board must first consider whether the service is needed, staff must prepare and administer a competitive process with a Request for Proposals (RFP), and staff must return to the Board to award the RFP. Many County departments, programs, and affiliated programs have expressed a need to allow mobile food vendors (food trucks) at events on County property. Changes to the Ordinance, as well as a Board policy providing direction on the vetting process and situations where it would be appropriate to use these vendors, would allow staff to efficiently process such requests.

Board Policy A-3 on Ordinances requires that proposals for new ordinances and ordinance amendments, other than minor amendments, shall first be presented to the Board for conceptual review and authorization. With Board approval, staff will return to the Board for a first reading of an amended ordinance and a Board Policy on this topic.

ALTERNATIVES
The Board could choose not to approve this recommendation, which would result in no change to the current ordinance or process for mobile food vendors.
