DISCUSSION / BACKGROUND
The Board formed the Barnett Business Park Zone of Benefit #98534 (Zone) on October 7, 1986, by Resolution 316-86, in response to a petition submitted by the property owners to form the Zone to fund street lighting services, and it was not a condition of development. No Advisory Committee was established for the Zone.

In 2000, installation and energizing of the street lights were completed within the Zone boundaries. In Fiscal Year (FY) 2000-01 and each year until FY 2007-08, the cost of the utility bills for the street lights exceeded the total benefit assessment for the Zone, depleting the reserve fund balance that had accrued between the years of 1990 and 2000 due to the annual shortfall of $2,633. The cost of providing street lighting services in the Barnett Business Park Lighting Zone was ultimately subsidized by the Road Fund in fiscal years 2007-08 and 2008-09, with the intent that the amount paid, totaling $3,111.20, would be repaid by the zone.

On July 29, 2008, the Board conducted an assessment ballot proceeding to consider increasing the benefit assessment from $61 to $162 per parcel to cover the cost of providing street lighting services. This amount was based on an approved Engineerin...
