Hearing to consider the Planning and Building Department, Long Range Planning Unit and Department of Transportation (DOT), proposed amendment to repeal Chapter 130.72 (Missouri Flat Planning Cost Reimbursement Fee) from the Zoning Ordinance, Title 130; and staff recommending the Planning Commission forward a recommendation to the Board of Supervisors (Board) to take the following actions:
1. Approve the amendment to repeal Chapter 130.72 Missouri Flat Planning Cost Reimbursement Fee from the Zoning Ordinance, Title 130; and
2. Find that the adoption of this amendment is not a Project for purposes of the California Environmental Quality Act (CEQA) because it is a government funding mechanism or other government funding activity within the meaning of CEQA Guidelines Section 15378(b)(4).

DISCUSSION / BACKGROUND
On December 9, 2025 (Legistar file 25-1961), the Board of Supervisors (Board) approved and authorized the Chair to sign Resolution of Intention (ROI) 187-2025 directing the Planning and Building Department and DOT to initiate the process of repealing Chapter 130.72 (Missouri Flat Planning Cost Reimbursement Fee) and to temporarily stop the collection of the Missouri Flat Planning Cost Reimbursement Fee effective on the date of the ROI until the Ordinance amendment was brought back for hearing (Attachment B, Exhibit A).
Following adoption of the ROI, staff prepared the proposed amendment (Attachment B, Exhibit B), which displays Chapter 130.72 in strikethrough format to indicate its proposed removal. The proposed amendments would be effective 30 days after final adoption by the Board.
