Department of Transportation recommending the Board:
1) Accept the road improvements for the Offsite Road Improvement Agreement for Green Valley Road at Deer Valley Road, TM 07-1440-R-2, as complete;
2) Reduce Performance Bond EACX4020409 from $85,316.00 to $8,531.60, which is ten percent of the total cost of the road improvements. This amount guarantees against any defective work, labor done, or defective materials furnished, which is to be released after one year if no claims are made;
3) Hold Laborers & Materialmens Bond EACX4020409 in the amount of $85,316.00 for six months to guarantee payments to persons furnishing labor, materials, or equipment; and
4) Authorize the Clerk of the Board to release the respective Bonds after the required time periods upon written request by Transportation.

DISCUSSION / BACKGROUND
The Final Map for the Summer Brook project (TM 07-1440-R-2) was approved by the Board of Supervisors on October 11, 2022 (Legistar file 22-1717). Concurrently with that map, the Board approved the Offsite Road Improvement Agreement for Green Valley Road at Deer Valley Road, Agmt #22-55006 (RIA), between the County and the Developer, Summerbrook, El Dorado, LLC (Developer).
Work contemplated under the RIA originally included signalization of the intersection of Green Valley Road at Deer Valley Road, per the Conditions of Approval of the Summerbrook project. On September 26, 2023 (Legistar file 23-1699), the Board approved an amendment to the Final Map to alter Conditions of Approval 25 and 26 to remove the requirement for the installation of a traffic signal at Green Valley Road and Deer Valley Road, and to instead require the installation of intersection lighting. Pursuant to that change, the Board approved the First Amendment to the RIA, updating the scope of work, reducing the estimated project cost from $921,579.00 to $85,316.00, and extending the performance period from October 11, 20...
