DISCUSSION / BACKGROUND
A request has been submitted by David J. Evans and Lynette J. Evans, owners of Assessor Parcel Number 097-110-015, together with approval from Dale A. Yeske and Domini G. Yeske, owners of Assessor Parcel Number 097-110-037, requesting that the County of El Dorado, Board of Supervisors, vacate the entirety of the 50’ non-exclusive road and public utility easement encumbering said property. The easement is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.

The 50’ non-exclusive road and public utility easement was initially recorded on January 31, 1974, as Parcel A in Book 5, Page 36, by Donald R. Evans. On June 3, 1975, Parcel A was subdivided into four parcels: 1, 2, 3, and 4. The easement in question only resides on Parcels 2 and 3 and was shown on a secondary Parcel Map, recorded in Book 8, Page 1. Upon recordation of said resolution, the termination of the subject easement will apply to both Parcel Maps.

AT&T, Comcast, El Dorado Irrigation District, Pacific Gas & Electric and Dale A. Yeske and Domini G. Yeske, owners of Parcel 3, have not used said 50’ non-exclusive road and public utility easement for the purposes for which it was dedicated and find no present or future need exists for that easement and do not object to its vacation, and to that end, have all issued letters to that effect.
