DISCUSSION / BACKGROUND
A request has been submitted by Stacey L. Kesner, an unmarried woman, and Tyler Whitson, an unmarried man, as joint tenants, owners of Assessor Parcel Number 069-091-005, requesting that the County of El Dorado Board of Supervisors vacate the entirety of the 10-foot Public Utilities easement encumbering said property. The easement is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.
The 10’ Public Utilities easement, as shown on Parcel A of Parcel Maps Book 22 Page 71, was created by James Blackketter on December 11, 1978. The easement was never offered; it was neither rejected nor accepted by the County of El Dorado, and the map was recorded on December 11, 1978.
AT&T, Comcast, El Dorado Irrigation District, Pacific Gas & Electric have not used said portion of said 10’ Public Utilities easement for the purposes for which it was dedicated, and find no present or future need exists for that easement and do not object to its vacation, and to that end, have all issued letters to that effect.
