Chief Administrative Office recommending the Board approve a budget transfer to appropriate $78,106 in the Courthouse Construction Special Revenue Fund to allow for the return of monies owed to the State of California. The department recommends approval of this budget transfer to appropriate the return of collection money held in the Courthouse Construction special revenue fund.

DISCUSSION / BACKGROUND
A recent audit of the County by the State Controller’s Office identified a preliminary audit finding that collections from Fiscal Year 2012-13 through Fiscal Year 2016-17 held in the Courthouse Construction Special Revenue Fund are due back to the State. Collections of monies in this fund are a distribution from the Courts of penalty money collected persuant to Government Code 76000. Past monies collected have been used to accomplish several facilities projects at the county court houses including, but not limited to, ADA improvements, roof replacements, and interior improvements. In future years, improvements to the Court house will be the responsibility of the State, and the County will no longer manage the revenue generated from these fees for these purposes. The most recent facilities project with the courts concluded in Fiscal Year 2016-17 and therefore the remaining collection monies held in the fund are due to the State. The Chief Administrative Office Central/Fiscal Division is working with the Court Executive Office to discontinue the transfer of this money to the County going forward.
