DEPARTMENT RECOMMENDATION
Health and Human Services Agency (HHSA) recommending the Board adopt and authorize the Chair to sign the attached Resolution, thereby approving the Agency’s request to receive Federal Bureau of Investigation (FBI) criminal history information from the California Department of Justice (DOJ) as part of the initial recruitment, hiring, and or promotional procedures for Animal Services Unit classifications authorized to carry firearms when acting in the course and scope of their employment.

DISCUSSION / BACKGROUND
Per California DOJ Guidelines for Agencies Receiving CORI from DOJ, information shall be used by the requesting agency solely and shall not be reproduced for secondary dissemination. The California Penal Code section 11142 states: “Any person authorized by law to receive a record or information obtained from a record who knowingly furnishes the record or information to a person who is not authorized by law to receive the record or information is guilty of a misdemeanor.”

The attached Resolution is a required component of the DOJ for FBI approval to request and receive firearms clearance results.

Resolution 001-2006 was previously adopted by the Board on January 10, 2006, authorizing the Health and Human Services Agency access to state and federal level summary criminal history information for employment, licensing, or certification purposes for eligible employment. Adoption of this Resolution will allow the Agency to also request firearms clearance specifically for classifications within El Dorado County Code of Ordinances Sec. 6.08.014 - Authority to carry firearms.
