Background:
The original Agreement #625-S0811, as approved by the Board on February 26, 2008, was prepared by the General Services Department and provides for airport consulting, planning, environmental, geotechnical, design engineering and construction engineering services associated with County Airport facilities.
 
On March 15, 2011 the Board approved the First Amendment to Agreement for Services # AGMT 08-52526 (#625-S0811), which extended the term of the Agreement from March 20, 2011 to December 31, 2011, to allow the Consultant additional time to complete design engineering work that was in process for the Habitat/Security Fence and Gates Project No. 93124 (Project) at the Placerville Airport, and for the Department of Transportation (Department) to complete a Request for Qualifications process for a new contract.  
 
Reason for Recommendation:
The Department requests that the Board make findings pursuant to Article II, Section 210 b (6) of the El Dorado County Charter that there are specialty skills required for the work performed under this Amendment that are not expressly identified in County job classifications.
 
The expertise for airport engineering services requires specialized skills and knowledge that are not expressly identified in County job classifications.
 
Construction of the Project will not be completed prior to the Amended Agreement expiration date of December 31, 2011 because the Federal Aviation Administration (FAA) advised the Department that funding for this Project has been delayed until Fiscal Year 2011-2012.  As a result of the delay, the construction phase of the Project will not commence until weather permits in 2012.
 
The purpose of this Second Amendment is to extend the term of the Agreement to allow the Department time to receive the delayed FAA grant funds required to fund the construction engineering services necessary for the construction phase of the Project.  The Amendment will also update one of the County's notices recipients and the County's Contract Administrator and will bring the Agreement into conformance with current standards regarding Disadvantaged Business Enterprise Program requirements.  This Amendment does not change the not-to-exceed compensation amount of the original Agreement.
 
The original Agreement was for a three-year term.  This Second Amendment will extend the expiration date of the Agreement from December 31, 2011, as amended, to the later of June 30, 2013, or the completion of the Project.  Since the extended term of the Agreement, as amended, exceeds three years, the Department is requesting Board approval for this exception to the three-year term policy.
 
The Purchasing Agent reviewed and provided approval of the Department's request to process this Second Amendment to the Airport Consulting Services Agreement with Reinard W. Brandley, Consulting Airport Engineer, and concurs that the Department's request is in compliance with Board of Supervisors Policy C-17.
 
In accordance with the Feasibility Analysis, the Department is not required to notify an employee's association regarding this Amendment.
 
Action to be taken following Board approval:
1. The Board Chair will sign the two originals of the Amendment with Reinard W. Brandley, Consulting Airport Engineer.
2. The Clerk of the Board will forward one original fully executed Amendment to the Department for further processing.
